If your partner holds EU, EEA, or Swiss nationality and you have been living here as a family, your right to remain in the UK depends on the EU Settlement Scheme. Getting this right is not optional — it is essential.
Many families in our communities are sitting on Pre-Settled Status without realising it has an expiry date. Once that date passes without an upgrade to Settled Status, the right to remain can be lost entirely. Others never applied at all — perhaps because they did not know about the scheme, or because circumstances at the time made it impossible.

PRE-SETTLED STATUS VS SETTLED STATUS
Settled Status
- Granted if you were living in the UK for 5 continuous years by 31 December 2020
- Equivalent to Indefinite Leave to Remain (ILR)
- Allows you to stay in the UK indefinitely
- You can apply for British citizenship after meeting the residency requirements
- You must not have been absent from the UK for more than 5 consecutive years
Pre-Settled Status
- Granted if you had been in the UK for less than 5 years by 31 December 2020
- Lasts for 5 years from the date it was granted
- MUST be upgraded to Settled Status once you reach 5 continuous years
- If your Pre-Settled Status lapses without upgrading, you may lose your right to remain

CRITICAL — UPGRADE YOUR PRE-SETTLED STATUS ON TIME

MISSED THE EUSS DEADLINE?
The main EUSS deadline was 30 June 2021. However, late applications are still accepted where there are reasonable grounds for the delay. Accepted reasons include serious illness, mental health difficulties, domestic violence, being in care, or simply not knowing about the scheme. EUSS FAMILY PERMIT
If you are a non-EEA family member of an EU, EEA, or Swiss citizen who has EUSS Settled or Pre-Settled Status, and you were NOT in the UK by 31 December 2020, you may still be able to join them in the UK using an EUSS Family Permit.
